1. Ownership and Operation

The Alive Foundation Inc. (“we,” “our,” “us”), doing business as MorningCoach® (morningcoach.com), owns and operates this website (the “Site”), including any other websites, services, products, or communications owned and operated by The Alive Foundation Inc.

By using the Site, you agree to these Terms and Conditions of Use (“Agreement”) and all future modifications. We may modify this Agreement at any time, and your continued use indicates acceptance. For questions, contact [email protected]. If you do not agree, do not use the Site.

2. User Responsibilities

• Provide true, accurate, current, and complete information during registration.
• Keep your information updated.
• Providing false or incomplete info may result in suspension or termination.

3. Product Purchases & Billing

When purchasing, you authorize us to charge your payment method for the agreed amount and billing cycle until you cancel. You are personally responsible for all charges incurred through your use of the Site.

4. Digital Content & Access

• Digital downloads are available only during your paid access period.
• You are responsible for downloading and storing purchases during that time.
• Re-downloads after your paid access ends are not provided.

5. Cancellation Policy

• You may cancel your recurring subscription at any time.
• 72-hour notice is required before your next billing date.
• Cancellations with less than 72 hours’ notice may result in one more billing cycle.
• Upon cancellation, all membership access is revoked immediately.
• No partial-month or pro-rated refunds will be issued.

6. Non-Compete

From the start of membership and for 6 months after termination, you agree not to teach, coach, share, sell, or license MorningCoach® systems or processes, including but not limited to Intelligent Life Design™, Get It Done – NOW!™, Sacred 6™, or any membership-level ideas.

7. Refund Policy

All sales are final. We do not offer refunds or credits for any payments made, including partial periods, unused services, or dissatisfaction with the program.

8. Intellectual Property

All site content, materials, and software are the property of The Alive Foundation Inc. or its licensors. Use is limited to personal, non-commercial purposes only.

9. Privacy

Your use of the Site is subject to our Privacy Policy, available on the Site. By using the Site, you consent to our collection and use of personal information as outlined therein.

10. Limitation of Liability

• We are not liable for communications by you or third parties.
• We are not liable for content on external sites linked from the Site.
• No liability for errors, interruptions, defects, viruses, or technical failures.
• No liability for direct, indirect, incidental, or consequential damages.

Your sole remedy is to stop using the Site.

11. Indemnification

You agree to indemnify and hold harmless The Alive Foundation Inc., its directors, officers, employees, and agents from all claims, damages, or expenses arising from your use or breach of this Agreement.

12. Disclaimer of Warranties

All content, products, and services are provided “AS IS” without warranties of any kind.

13. Termination

We may terminate your account at any time. You may terminate by closing your account and paying any outstanding balance.

14. Jurisdiction

This Agreement is governed by Florida law. All disputes will be resolved exclusively in Okaloosa County, Florida courts. The losing party shall pay all reasonable attorney’s fees and costs.

15. Miscellaneous

This Agreement constitutes the entire agreement. If any part is unenforceable, the rest remains in effect. We may assign this Agreement at any time.
